Able Staffing (referred to as Able) reserves the right to modify these Terms & Conditions at any time.
Never provide personal information such as social security numbers, credit card info or bank accounts to unauthorized persons
This documentation acts as a binding agreement between you, the user, and Able, Inc., (referred to as “the company” or “Able”) or any Able, Inc company operating any website for the country/state where the user resides or in which business is conducted. It will be assumed that you, the user, agree to the terms and conditions outlined in this documentation each time site or services are accessed. Otherwise if you, the user, do not agree to the terms stated in this documentation, do not use Able's website(s) or services.
Able sites are ascertained as any website controlled by the company or it's affiliates and includes the services offered. Services are as any application and/or service offered by the company, including online services to post /search employment opportunities. Services may include any applications accessed through third party sites such as Facebook, mobile interfaces or third party software such as SmartJobBoard. Sites may also include tools used for communication such as Linked-In or other online communities and communication tools designed to promote professional/personal networking.
The company site allows users to create user profiles/resumes. These profiles/resumes may include personal information and may make this information or features derived from this information public. Also, Able may collect information about the user from public websites to be used for or to append an existing user profile. Although Able intends to use only credible information, the validity of the information gathered from third party public site is the sole responsibility of the third party site.
The company reserves the right to revise these terms anytime by posting updates to this Web page. It is the responsibility of the user to review the terms periodically.
Able Staffing provides a service to bring Job Seekers and Employers together. Job Seekers and Employers can register, create profiles/job posts and search for jobs and resumes.
Able's data, content and information are intended for registered users and shall be utilized only for seeking employment or fulfilling job postings.
Users are responsible for the confidentiality of their account, profiles, resumes and passwords. Users are responsible for use of any and all information they provide and shall not share passwords or account access with other parties. If unauthorized use occurs, it is the responsibility of the user to notify Able immediately.
Job Seeker personal data will be available to Employers visiting Able Staffing's website. Personal data includes a Name which is mandatory, an email Address which is mandatory and a Telephone Number which is optional.
Personal data provided by the user may be used by Able to notify the user of any news, and or promotional offers relating only to the Able Staffing website. The user can unsubscribe from these notifications at anytime.
Able Staffing will not willfully disclose user personal data to any third party.
Able makes no declarations that its website content may be viewed lawfully or accessed outside of the United States. Access to our content by certain individuals or in certain countries may not be legal. Access our site at your own risk. You are solely responsible for complying with laws where you live regarding the use of our site(s) and services. Changes to these terms shall be made by a revised posting of this page.
Able Staffing website may not be used for any of the following purposes:
The user is required to provide truthful information in their profile or job post.
It is prohibited to use any text or images from Able for personal or commercial use.
Able authorizes registered users to access and use our sites and content as outlined in any online agreements and these terms. Download and printing of content for personal non-commercial use is permissible only through agreement by prescription from our site unless Able otherwise gives authorization to do so. All content is protected under copyright, trademark and intellectual property laws and is the exclusive property of Able. Unauthorized use of our site, services and content is strictly prohibited. Authorized usage of any of these items must preserve all copyright, logo, trademarks and or proprietary information and notices contained in the original authorized copy of any content the user makes.
It is understood and agreed by the user that any code created to display or generate content, pages, products or services is also the property of Able and is subject to all laws governing such. Code shall not be copied, adapted, reproduced or otherwise manipulated in any form for personal or commercial use. It is prohibited by the user agrees to in no way misuse our content and to in no way use its content on any outside application, website or other computer or mobile environment for any reason or purpose.
Able Staffing does not hold responsibility for any untruthful and/or inaccurate information included in job posts and profiles.
Able reserves the right to edit or delete any information submitted by the user to the website.
(a) that all information submitted by you is the sole responsibility of the user from which content originated originated and it is your sole responsibility to protect any and all copyright materials presented;
(b) that information pertaining to the user must describe that user and not be fictitious or otherwise inappropriate;
(c) that Able reserves the right to deny acceptance, posting, displaying or otherwise transmitting any user content at our discretion.
(b)that by becoming a registered user, you grant Able a worldwide, non-exclusive, royalty-free, transferable, sub-licensee license for usage of any kind for the content you give including for the purpose of promoting our site, services and products. This may include but is not limited to publication, distribution, display, copying and adapting of said content;
(d) to be of an age to legally work under local and federal laws. If user is under the age of 18 or the age of majority as per state, local or federal laws where you reside, supervision of a parent, legal guardian, or other legally responsible adult to use the site is required;
(e)that Able does not endorse any opinions expressed by users;
(f)that reliance on material found on our site will be at your own risk;
(g) not to engage in activities that inflict an unreasonable load on any of the company's framework including but not limited to databases and broadband;
(h) to use only devices and tools approved by our company for the purpose of using, searching or navigating our sites;
(i) not to use data mining, robots or similar data gathering or extraction methods. It is prohibited and will be considered a violation of Able rights;
(j) not to violate or make any attempts thereof to violate security measures of the company site(s) including but not limited to probing, scanning or testing the system, network or vulnerability without authorization from an authorized company official. This is strictly prohibited and may be prosecuted according to law;
(k) Not to copy, forge or reproduce in any manner any part of the header information from the company website(s) in any e-mail, newsgroup, website or other form of communication not mentioned unless granted written permission from Able, Inc has been obtained.
(l) Reverse engineering or dismantling of any part(s) of any Able site is strictly prohibited. Violators will be considered as infringing upon our rights.
(m) Not to destroy, transmit, post, link, frame, copy, store, forge, distribute or reproduce in any manner content, material or information available from any Able site, including but not limited to current or expired job postings and resumes other than as permitted by these terms; To do so may and will be considered a violation of laws and regulations including but not limited to the collection, processing, or transfer of such information;
(n) that any data, information and/or content submitted by the user contain or can be interpreted as direct or indirect commercial advertising or solicitation;
(o) that data submitted by you has your permission to be accessed, displayed, viewed, stored and reproduced for non-commercial use by other registered users;
(p) that Able has the right to restrict emails or messages sent to other users;
(q) that Able may review all content submitted and has the right to remove any content at our discretion for reasons which may include but are not limited to violation of laws, contain abusive offensive disruptive language, violation of the rights of others or which may considered a threat to our users, site or services;
(r) Not to post content that promotes or endorses illegal activities or instructional data about such activities. Examples of such activity include but are not limited to the buying, providing or creating of illegal weapons, pornography, computer viruses, pirated media or pirating software;
(s) Not to post any resume or profile information nor apply for any job on behalf of another party. All information submitted by a user must pertain to that individual only;
(t) Not to transfer any contact information from an employer or company to any job seeker, agent, agency, or other third party with permission from that employer or company;
(u) Not to submit more than a single copy of the same resume to the public at any one time;
(v) Not to share any login credentials from our site to any third party;
(w) Not to access data not intended for you, the user, or to log onto a server or account for which you do not have authorization to do so;
(x) Not to post or submit any fragmented, fictitious, or inaccurate information in resumes, biological data or demo-graphical data;
(y) Not post restricted or password protected pages, hidden pages or images;
(z) Not to alter/delete any information or material posted by any other person, company or entity;
(aa) Not to harass or incite badgering of any group, company, or individual by posting or submitting content that may be considered by any person, group or company as defamatory, offensive, obscene, threatening, abusive, racist or may cause an individual to feel threatened, annoyed, embarrassed, annoyed or otherwise uncomfortable in any manner; Using our services in this manner may result in civil or criminal actions. Able will always give full cooperation and known information to any law enforcement agencies and authorities for such investigations and cases of prosecution.
(bb) Not to use any information from our site for the purpose of promoting or advertising any product or service either legal or illegal to any user through any means including but not limited to email, phone calls or faxes. Contact information may be used only for the purpose this site for employment or job posting;
(cc) that creative suggestions of any kind shall not be made through this website to Able and that if done so shall become the exclusive property of Able and are not subject to confidentially on our part. Able will also retain rights to such submissions discovered in the future known or unknown for any purpose whatsoever;
(dd) Not to use the content or profiles or any information provided for the purpose of discrimination of any sort as determined by local, state and federal laws. It may not be used to determine eligibility for credit, insurance, employment, and/or licensing nor shall it be used as any screening tool where discrimination becomes a factor.
(a) any profile and resume created by you, the job seeker, must be accurately and factually represent the registered job seeker and must contain a valid email address;
(b) to take sole responsibility of information content and accuracy provided by you in forms, resumes, profiles and any place information may be used by companies or on our website;
(c) to not disclose contact information outside forms created by our website including phone numbers and addresses
(d) that you have no ownership rights to your account;
(e) that if your account is canceled or terminated all information including resumes, profiles, cover letters, saved jobs, etc. may be deleted at our discretion from our databases and that saved copies may be retained by third parties.
Note: We reserve the right to delete accounts and all of your Information during significant periods or for other reasons at our discretion.

Able is not the employer of anyone hired through the use of our site/services nor are we responsible for employment decisions made in lieu of any job posting.

profiles, resumes and other data derived from job seekers is not screened for accuracy or validity unless otherwise noted. Profiles or resumes developed outside of our website may differ from user content and Able does not insure its accuracy or validity for employer evaluation.
(a) any hyperlinks to third party job boards unless authorized by Able;
(b) any misleading words or advertising that are irrelevant to the job opportunity being presented and shall be determined by Able's reasonable discretion if questionable;
(c) the name, logo or trademark of any company other than those you or your company are affiliated with unless agreed upon by Able and the company owning said name, trademark, or logo;
(d) the names of educational institutes or geographical locations unrelated to the job posting;
(e) inaccurate, erroneous, or deceptive information about your company, its employees or the job opening;
(f) information,material or links that exploits people in any illegal manner from anyone under 18 or consenting age as outlined by local, state and federal laws.
(a) comply with applicable local, state, federal, national and international laws, including but not limited to laws regarding economic sanctions, labor, equal employment opportunity, eligibility requirements, all aspects of data and intellectual property and shall disregard requirements of information which may lead to discrimination practices such as age, racial or ethnic origin, political, philosophical or religious beliefs, membership in certain groups or trade unions or sexual life for example.
(b) not require as a condition of employment citizenship of any particular country or lawful permanent residence in a country unless required in order to comply with laws, regulations, executive orders, or federal, state or local government contracts;
(c) exclude any screening conditions where such a condition is not an actual and legal requirement of the posted job;
(d) exclude advertisements and links for competitors of Able;
(e) promote the job opportunity and the company offering the job but shall not sell, promote or advertise products or services of that company unless as part of the job description;
(f) not advertise for services or seek employees for jobs of a sexual nature including but limited to reproductive services;
(g) refrain from endorsing religions, political parties, agenda, positions or issues unless as required by the job.
Note: Able reserves the right to remove job postings or content upon our discretion that we believe does not not comply with these terms or which may not represent the best interest of our company. Intentional or unintentional misrepresentation regarding the nature of your business or its activity may lead to breach of contract and termination of registration.
(a) take sole responsibility for the use our resume database per our terms and conditions and that all data and information is the property of Able;
(b) use resume information in accordance with all protection laws including that of data and privacy;
(c) keep private and confidential all information as per local, state, federal, national and international law and shall not disclose information to a third party unless authorized to do so for employment purposes such as in cases of recruiting agencies or staffing companies;
(d) take appropriate measures including physical, technical or administrative to protect data and information obtained from our database from misuse, loss or unauthorized access to such data and information;
(e) use information obtained to identify job seekers for recruitment and to make contact with these individuals
(f)keep private and confidential login criteria which licenses the company to use our site/services and shall not share this information with any party outside that of the registered company;
(g) use the resume database for the sole purpose of an employer seeking employees and shall not be used for job fair recruitement or business opportunities.
When using Able sites and services from a mobile device such as cell phones and tablets, the user agrees:
(a) use of the site may be communicated to us from the site or your mobile device carrier including such information as location, type of device, or carrier;
(b) that data through the device may be displayed on or through that mobile device and that the user of said device is the solely person responsible for the transfer of that data;
(c) to promptly update Able account information in the event of changes to your mobile device including but not limited to change in number, carrier account, deactivation. Failure to do so is solely your responsibility and may result in your messages being sent to a person that acquires an old number.
(d) to be responsible for all billing and fees, including data charges, that may incur from the mobile access provider relating to the access of our sites and services through the mobile device. Note: It is advisable to check with your provider prior to using any mobile device and to check your carrier terms and conditions regarding data usage.
(e) to accept full responsibility for agreement to any separate terms, conditions and license agreements associated with applications provided for download or installation for use in conjunction with our sites and services.
Able will not be responsible for any loss or damage the user may encounter from using the website.
Able does not take responsibility for screening or censoring of the information provided from its users. Transactions and communications between users such as employers and job seekers is between the parties involved and is not controlled by Able. We do not control nor resume responsibility nor do we represent the user content, its quality or truthfulness, the safety or legality of jobs offered or the ability of job seekers to fill the position or the employers ability to provide the job.
We reserve the right to remove content including resumes and job postings but are not obligated to do so and we disclaim liability for any failure to take such action. Users are responsible for all risks involved in using our sites and services including those interacting with alternative users.
Because of its nature, Able can not and will not resume responsibility for the actions or dealing of our users. If you have a dispute with another user, you acknowledge and agree to release, indemnify and hold harmless Able and all its affiliates from any lawsuits, claims, actions, damages, demands and causes of action of any kind and/or nature arising as a result of such disputes to the fullest the law will permit.
Although it is not our intent to do so, Able sites and its content may contain inaccuracies or typographical errors. Therefore, we do not make portrayals about its accuracy or reliability nor its completeness of any site, service or content. Remember to use our site is to do so at the users own and we do not guarantee or promise definite or particular results. Changes to our site may be made at our discretion and at any time and it is the responsibility of the user to review these updates and changes.
It is the sole responsibility of the user to back-up user content. Able is not liable for deletion or unauthorized use or modification of user content. Able reserves the right to charge for services that require assistance for such circumstances.
If the user resides or is a reside of California or otherwise falls under the jurisdiction of California law, that user acknowledges and agrees to waive his/her/its rights under California Civil Code Section 1542 when using Able or its affiliates sites or services.
Users acknowledge and agree not to sell or appoint their user rights or accountability.
Although Able tries to ensure a quality experience for our users by offering third party products and services to users for their convenience, Able is not responsible for third party products, services or links provided to its users including but not limited to quality or nature of such items purchased or otherwise obtained. Furthermore, we do not warrant or guaranty these third party products or services. Furnishing of said items is solely between the user and the third party provider. Users resume responsibility for obtaining and/or using all third party products, services and/or links. Complaints about third party items will be investigated by Able and at our discretion may result in removal of the third party information. Able is not liable or responsible to users in any way for fulfillment or nonfulfillment of such measures.
Able's liability originating out of or in connection with the usage of our sites or its content shall not exceed $10.00 in United States currency regardless of cause of action as per the fullest extent of the law.
All users agree to defend, indemnify, and hold harmless Able Staffing, Able Inc, its affiliates, and their respective officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from any user content or other material the user provides to any Able site, user's use of any Able content, or user's breach of these Terms.
California users or users that otherwise fall under the jurisdiction of California law, acknowledge and agree to waive his/her/its rights under California Civil Code Section 1542 when using Able or its affiliates sites or services.
Although Able strives for providing users the best experience possible, we do not pledge that any of our sites or services will operate error free or be free of computer viruses or other harmful devices. Although we will take reasonable precautions to protect our site, services and products, the user acknowledges and agrees that Able will not be responsible for any costs resulting or associated with servicing or replacement of equipment or data lost, damaged or otherwise altered as a result of using our site and/or services. Our site, services and content are provided on an “as is” basis and we make nor warranties or guarantees about the accuracy, comepleteness or reliability of our content, services, or products, etc.

Soliciting passwords or personal identifying information from other Users.
Unauthorized commercial use of our site(s) or services
Other reasons at our discretion and/or are outlined in these terms
These terms will remain in full force and effect while you are registered as a user of any Able site/service. Any violation of these terms and conditions will be considered a breach of contract by the user. User may be considered in breach of contract if Able is unable to validate any information submitted during registration. We reserve the right to pursue all of our legal avenues in these and any manners concerning the use of our site and services. This may include but is not limited to removal of user content from any and all sites owned and operated by Able as well as termination of registration with and access to any sites and/or services provided to you, the user. Certain provisions shall remain in effect as long as a user is considered registered even when that user chooses not to take advantage of available services.
